The Borrowed Pen Project™ (“we,” “our,” “us”) provides pens, merchandise, and an interactive storytelling platform. You must be at least 18 years old, or have the consent of a parent or guardian, to use our Services.

We reserve the right to update, change, or replace any part of these Terms at any time. Updates will be posted on this page with a revised “Effective Date.” Continued use of our Services means you accept the updated Terms.

2. Products & Orders

  • All Sales Final: All sales are non-refundable.

  • Defective Items: If your pen arrives defective, we will replace it at no additional cost.

  • Product Availability: We may limit or cancel quantities purchased and reserve the right to discontinue any product at any time without notice.

  • Pricing: All prices are subject to change without notice. Taxes will be applied where applicable.

3. User-Generated Content (Stories, Names, Submissions)

The Borrowed Pen Project™ encourages customers to share stories connected to their pen’s journey. By submitting a story, name, or other content (“User Content”), you agree to the following:

  1. Public Sharing: Your story, name, and submitted content may be publicly displayed on our website and shared across our social media accounts and other promotional channels, including but not limited to Instagram, Facebook, TikTok, Pinterest, YouTube, print publications, and press releases.

  2. Marketing Use: We may use your submission for advertising, marketing campaigns, promotional materials, or any other brand-related content without additional notice or payment.

  3. License: You grant The Borrowed Pen Project™ a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, distribute, and display your content in connection with our Services.

  4. Responsibility: You are solely responsible for ensuring your submission does not infringe on copyrights, trademarks, privacy rights, or contain illegal/offensive material.

  5. Moderation: We may refuse, edit, or remove content at our discretion.

4. Intellectual Property

All content, branding, logos, designs, and intellectual property associated with The Borrowed Pen Project™ are owned by us or licensed to us. You may not reproduce, copy, or distribute our materials without prior written permission.

5. Payments

Payments are processed securely through Shopify and its integrated payment providers. We do not store your payment details. By placing an order, you agree to provide accurate billing information and authorize us to charge your payment method for your purchase.

6. Shipping & Delivery

  • We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.

  • Any duties, taxes, or import fees for international shipments are the responsibility of the customer unless otherwise stated.

7. Limitation of Liability

To the fullest extent permitted by law, The Borrowed Pen Project™ is not liable for any indirect, incidental, special, or consequential damages arising from your use of our Services or products. Our total liability for any claim related to a purchase will not exceed the amount you paid for the product in question.

8. Dispute Resolution

Any disputes will be resolved in accordance with the laws of the State of North Carolina, USA. You agree to first attempt to resolve disputes informally by contacting us before pursuing legal action.
